Special Counsel Jack Smith received a new timeline for his attempts to appeal the dismissal of former President Donald Trump‘s classified documents case.

On Thursday, Kyle Cheney of Politico shared a post on X, formerly Twitter, showing a briefing notice from the 11th Circuit Court of Appeals. The document said that Smith’s appeal is due on August 27, 2024.

“Standard briefing schedule runs through mid-October unless Smith seeks to expedite,” Cheney wrote in the post.

The new timeline comes shortly after Smith told U.S. District Judge Aileen Cannon that he planned to appeal the ruling made in Trump’s classified documents case.

Earlier this month, Cannon issued a bombshell ruling that declared Smith’s appointment as special counsel unconstitutional, effectively halting one of two federal cases against Trump. The former president faced 40 charges, accused of mishandling classified documents at his Mar-a-Lago estate in Florida.

This is a developing story that will be updated as more information becomes available.
